Thank you for taking a few minutes to review the general terms and conditions of sale that apply to all sales concluded through the website www.gien.com for items sold and shipped by the Gien Pottery. Gien may revise these terms and conditions at any time, which is why we recommend that you consult these pages regularly. ARTICLE 1 - CHARACTERISTICS OF THE PROPOSED ITEMS
We strive to present the most up-to-date and accurate information on our website. However, the information on gien.com may occasionally contain incomplete data, errors, or inaccuracies. All errors are unintentional. We apologize for any inaccuracies, such as pricing or product availability, that may occur on our site.
Any discrepancies or errors that may occur shall not, under any circumstances, render the Gien Pottery liable or give rise to any claim by the customer. The photographs and descriptions of the items are as accurate as possible, but cannot guarantee a perfect likeness to the items presented, particularly with regard to colors. Due to variations in screen displays, we cannot guarantee an accurate representation of colors.
When an item featured on gien.com is no longer in stock, it is removed from the site. Most Gien products displayed on our site are normally available, but may sometimes become unavailable before we have had time to remove them.
We make every effort to respond to your emails promptly; however, Gien is under no obligation to reply to all emails received through this website. We do not wish to receive confidential or private information via this website or any email link. Please note that all comments, ideas, and suggestions communicated to our company through gien.com will become and remain the property of Gien.
We reserve the right to correct errors or update information at any time without prior notice.
ARTICLE 2 - ORDERING PROCEDURE
Order confirmation implies acceptance of these General Terms and Conditions of Sale, including the Privacy Policy, acknowledgment of having read and understood them fully, and a waiver of any other conditions.
All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute a signature and acceptance of the operations performed.
ARTICLE 3 - ORDER CONFIRMATION
Once the contract is concluded according to the order placement procedure described, the Gien Pottery will send the customer an email confirming their order and summarizing the information contained in the submitted order form. By saving and/or printing this email, the customer retains proof of the order, which the Gien Pottery recommends they keep. However, this email only confirms that the customer's order has been received by the Gien Pottery and not that the ordered item(s) are available.
In the event that the ordered item(s) presented on the Faïencerie de Gien online store are no longer available or for sale at the time the customer sends the order form, the customer may terminate the contract by registered letter with acknowledgment of receipt or in writing on another durable medium if, after having enjoined the Faïencerie de Gien, according to the same terms, to make the delivery within a reasonable additional period, the latter has not complied within this period.
ARTICLE 4 – SALE PRICE
The selling prices of the items are expressed, for all countries, in euros inclusive of all taxes (VAT included, to avoid any competition with foreign partners), excluding delivery charges. Any delivery charges are the responsibility of the customer and are billed in addition to the selling price of the items.
Item prices may change at any time. The selling price for each item is the price displayed on the Gien Pottery online store at the time the order is placed, except in the case of typographical errors.
Any change in the value added tax (VAT) rate will be immediately reflected in the selling price of the items.
In some cases, the prices displayed in Gien stores and partner shops may differ from the prices visible on gien.com depending on the commercial operations implemented in the different distribution channels.
ARTICLE 5 – PAYMENT METHODS AND INVOICING
All purchases made on the Gien Pottery online store are payable at the time of order. The only payment method accepted by the Gien Pottery for purchases made on the online store is credit card. We do not accept checks.
ARTICLE 6 – TRANSACTION SECURITY
When you make a purchase on the Gien Pottery online store, the entire payment process is handled directly between you and Crédit Agricole. During the credit card payment phase, you will temporarily leave the www.gien.com website and be redirected to the "Crédit Agricole Payment" page.
This guarantees that:
The Gien pottery factory will never know your card number.
Crédit Agricole will not be able to know the details of your purchases since only the total amount and order number are transmitted to "Payment Crédit Agricole" by the Gien Pottery.
You are not required to have a bank account with a Crédit Agricole bank. In a few seconds, you will know whether your payment is accepted or declined, and you can then continue browsing.
Paying for your purchases with "Crédit Agricole Payment" incurs no additional fees. For your security, all data exchanged during transactions is encrypted.

The choice of carrier is made by the Gien Pottery when the order is processed. We reserve the right to group several orders placed within a short period of time, with the same delivery address.
The return costs for the defective or non-compliant item(s) will then be covered by the Gien Pottery.
However, the Gien Pottery will be exempt from all or part of its liability by providing proof that the non-performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
ARTICLE 8 - FORCE MAJEURE
The Gien Pottery cannot be held liable for any failure to fulfill its contractual obligations in the event of force majeure and unforeseen circumstances such as natural disasters, fires, internal or external failures or breakdowns, and in general any external, unforeseeable and irresistible event preventing the proper execution of orders.
ARTICLE 9 - CUSTOMS DUTIES
Any order placed on the website www.gien.com and delivered outside of France may be subject to potential taxes and customs duties levied when the package arrives at its destination. These customs duties and any taxes related to the delivery of an item are your responsibility. We are not required to verify or inform you of applicable customs duties and taxes. To find out what these are, we advise you to contact the relevant authorities in your country.
ARTICLE 10 - RIGHT OF WITHDRAWAL
The Customer has a withdrawal period of fifteen (15) days from the delivery of the order placed on www.gien.com.
During this period, the customer may return, at their own expense and without further penalties, the item(s) that do not suit them.
Such a return will only be accepted by the Gien Pottery Factory if:
To exercise the right of withdrawal, the customer must notify Faïencerie de Gien of their decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or email). The customer may use the model withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for the customer to send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.
The returned item(s) must not have been used, altered, washed, or damaged;
The returned item(s) are still in their original packaging;
Returned items are sent in a single shipment, as the Gien Pottery reserves the right not to accept items from the same order that are returned and shipped at different times.
If this right of withdrawal is exercised under the conditions defined above, the Gien Pottery will take the necessary steps to reimburse any sums already received in consideration of the purchase of the items.
Any sums already collected will be refunded as soon as possible and in any case, within fourteen (14) working days following the date on which the Gien Pottery became aware of the exercise of the right of withdrawal by the customer, regardless of the payment method used.
In the event that the conditions for exercising the right of withdrawal described above have not been respected, the customer may obtain at his own expense the items returned to the Gien Pottery in the condition in which they were returned to the Gien Pottery.

ARTICLE 11 - PRODUCT WARRANTY
The products sold on the online store benefit from the legal guarantee of conformity under the conditions provided for in articles L. 217-4 to L. 217-13 of the Consumer Code as well as the guarantee against hidden defects as defined in articles 1641 to 1649 of the Civil Code.
In the event of non-compliant or defective product(s), customers may return them under the conditions set out in Article 6, provided they have first contacted Customer Service by calling 02 38 05 21 50
Upon receipt of the returned products, the Gien Pottery Factory will send the customer replacement products, provided they are available. If not, the Gien Pottery Factory will issue a full refund to the customer.
ARTICLE 12 - PRIVACY POLICY
In accordance with the French Data Protection Act of 6 January 1978, personal information relating to customers may be subject to automated processing.
The Gien Pottery Factory reserves the right to collect information about customers including through the use of cookies, and, if it so wishes, to transmit the collected information to business partners.
Customers can object to the disclosure of their contact details by notifying the Gien Pottery.
Customers have the right to access and rectify data concerning them, in accordance with the Law of 6 January 1978.
